Rental Apartments Terms and Conditions
Expect honesty, integrity, and transparency in all our dealings
Published rents:
The rents published at BAStay.com are final and include building related fees, city taxes, water, electricity, gas, linen and towels (usually changed once a week). Cable TV, internet and maid service are only included when specifically stated in the details of the property listing. When we state that telephone service is included, that means there is a controlled landline in the apartment used to receive calls only. To make outgoing calls a calling card must be used, which are available at any area Kiosk. As third party services to include telephone, cable and internet are sometimes unreliable here, we always recommend you obtain a free cellular phone (FREE phone rental - you only pay for calls) and a GSM wireless internet card if the internet is important. Note: This problem is not unique to BA Stay apartments! We promise to ‘tell it like it is!’
Fees for vacation rentals up to 6-months
In addition to the published rent, BAStay.com charges a flat fee for services fixed at the rate of USD $45. We levy this charge to cover the cost of administration, telephone calls, preparation of a rental contract, and check-in during normal office hours. There are no hidden charges and rents are fully inclusive of all costs noted above.
Additional fee for early or late check-in
Clients agree to pay an additional fee of USD$20 for early or late check-in. Early and late check-in is defined as any time before 09h00 AM or at 19h00 PM or later, all day Saturday and Sunday, or during any public holiday. NOTE: for Christmas and New Years the additional fee is USD$40. There are no hidden charges and rents are fully inclusive of all costs noted above.
Same Day reservation and check-in
Clients agree to pay an additional fee of USD$20 for same-day reservations and check-in. There are no hidden charges and rents are fully inclusive of all costs noted above.
Additional fee for late checkout
Check-out time is 10h00 AM and is conducted by the property owner and not BA Stay. Charges for a late check-out are set by the property owners and could be as high as the prorated fee for one additional day’s rental. Check-out time is subject to the property owner’s availability and must be agreed to in writing at the time of making the reservation or at check-in. We advise you to agree check-out time when making a reservation.
Vacation rentals over 6 months
When a lease covers a period longer than 6 months, you will be required to support the contract with a guarantee of some kind. Guarantees can include acceptable security, property ownership in the city or province of Buenos Aires, prepayment of the contract, or any other form of security deemed acceptable by the property owner.
Please note that the terms BA Stay rental agreements for rentals over 6 months are different to those agreements signed for vacation rentals. Rentals for periods over 6 months may be considerably cheaper than the actual rents advertised on our website, but often do not include building related fees, city taxes, water, electricity, gas, or cleaning services.
Longer-term rental agreements are not possible without a guarantee and entering into a contract for 1 to 2 years. In addition, clients pay the first and last month rents and a security deposit at the time of signing an agreement with the owner.
Fees for vacation rentals over 6 months
We charge and clients agree to pay 5% commission fee in advance, payable by the client on the total rent due for the rental period. The same 5% commission fee applies to any extensions to the contract as well. Clients agree this fee is immediately payable by the client without demand when signing a lease agreement with the property owner.
Online reservations, electronic data transmissions and emails
Our website clearly states the terms under which property owners offer their properties. By making a reservation with BA Stay, clients are indicating acceptance of the owner’s terms and conditions, the terms and conditions herein, and the General Conditions for Owners and Users published on our websites. Please note that the non-refundable rental down payment, rent balance, security deposit and our fee are payable in full subject to these terms before entering into a rental agreement. BAStay.com accepts that automated transmissions of data and emails can suffer corruption, loss of data, errors or omissions. Such errors do not bind us and the published rent, security deposit, and our fee are always payable by clients in full subject to these terms and conditions.
Reservations require your immediate confirmation with a non-refundable down payment of 20% of the total rent and our fee. We use the following method to calculate your total rent:

The Security Deposit shall be calculated according to the length of the stay
When paying a rent down payment, clients agree to pay the balance of rent payable and security deposit in full and in cash at the time of check-in. If paying at the time of check-in BA Stay will only accept US dollars. A written agreement is required ahead of time to pay in Argentine pesos at the time of check-in and will be calculated using the Venta Rate published at dolarhoy.com. If you want to avoid exchange fees, you seek agreement to pay the Security Deposit using dollars, sterling or Euros. Only, when agreed in writing will BAStay.com hold a clients’ security deposit or vary any of our terms herein.
Money Exchange Policy
Rents are payable in dollars, but property owners will often accept Argentine PESOS (only by prior written agreement) at the ‘Venta’ rate as detailed at dolarhoy.com. During times of currency instability, the property owner may state their rate in advance subject to his or her discretion.
Duration of the Stay
A rental agreement regulates the minimum and maximum time during which a client may stay in a rented apartment. An essential element of the contractual relationship is that the rental agreement has a specific beginning and an end, with no automatic extension.
In the event that the client wishes to extend the duration of the lease, BA Stay must be notified in writing before the termination date of the rental agreement in effect at the time. It shall only be possible to enter into a new agreement if the apartment is available for the desired term or the new agreement. In this case, we calculate the cost of the extension according to the terms specified on our website and the client must pay us a contract renewal fee of USD $30 plus any other applicable fees as noted above. Should clients conduct business directly with our property owner and exclude BA Stay from the transaction, the client agrees to pay us both our administration fee and the publishing fee payable by the property owner that are subject to our General Conditions for Owners & Users.
Check-out and your security deposit
The property owner conduct the check-out (or on occasion a concierge depending on circumstances). Return of the security deposit in full is a contractual part of a clients agreement with the property owner provided the client return the apartment in the exact same condition as when moving into the apartment. The rental agreement allows for deductions for the costs of repairing any damage caused by the client from the security deposit. In the event that repair costs exceed the total security deposit amount, the difference is payable immediately by the client on demand and is subject to the property owner providing receipts for repairs or replacement of their property. To avoid difficulties or delays on the day of departure or the retention of a security deposit until repairs are completed, we advise the client to notify the owner and us of any damage caused to the apartment or its contents at least 72 hours before departure.
Liability
BA Stay is the publishers of rental properties and tourist services. The liability of BA Stay shall only cover the business activity of introducing and facilitating people who are seeking properties to contact owners of real estate who are offering apartments for both temporary and long-term leases and find providers of tourist services.
It is thus worth mentioning that we do not act on behalf of the property owner or manage their properties; rather, our websites constitute a means of publishing real estate offers and services and bringing together potential clients and property owner and/or service providers .
The photographs published at BAStay.com may not necessarily represent an apartment's current condition and sometimes colors seen in photographs may differ from the actual colors. Additionally, the property owners (and not BA Stay) are fully responsible for the property details published on this website. However, BA Stay makes every reasonable effort to keep our property database fully up-to-date and our concierge visits all the apartments to ensure that they meet the criterion as published on this website.
The client agrees to ensure that all is in order before paying their rent and security deposit and entering into a legally binding rental agreement with a property owner, always taking into account that during our check-in compliance if the apartment is not as advertised, we can move the client prior to check in.
NOTE: Buenos Aires is a noisy, sometime dirty and polluted city and neither BA Stay nor the property owner is responsible for noise or external pollutants and such concerns are not just cause for cancelling a rental agreement. If you have health concerns or pre-existing conditions that may be aggravated by noise or pollutants then South American cities are probably not for you.
In the event of unexpected damage caused to the property before a client’s arrival, or any other reason that prevents the tenancy (such as a property owner cancelling your reservation) we accept no liability other than to inform our client of this unexpected situation and offer two alternatives:
If client decides on option a) we will use every reasonable effort to find a suitable alternative rental apartment. In the event of unexpected damage caused to the property during a client’s stay (that was not the fault of the client) that prevents the client from remaining in the apartment, we accept no liability other than to use every reasonable effort to assist our client in resolving the problem(s). You agree that you are our client subject to these terms and conditions herein, but a rental agreement governs the terms that you agreed with the property owner, therefore you agree to meet your contractual obligations and with our help resolve your complaints directly with the property owner with our assistance where necessary. We do not manage properties and are not responsible for problems outside of our control, or any issues that are governed by the rental agreement clients sign with the property owner. Our management team will make every reasonable effort to achieve an equitable resolution to problems. We request and clients agree to be objective and helpful during any complaint resolution or mediation. When a serious problem arises and we are unable to help you resolve the problem:
If client decides on option a) and this is not possible, we will inform the client so that they can find their own apartment and opt for option b).
BA Stay would like to be clear on the fact that Buenos Aires is a very noisy city and clients accept that we cannot cancel a rental agreement and move a client due to noise concerns or because of minor unforeseen circumstances or disturbances without the property owner’s agreement. In the event of cataclysms, floods, earthquakes, storms, or any disaster of nature, attacks on property or person, acts of vandalism or events that are outside the control of BAStay.com, such as general blackouts or gas cuts arranged by utility companies or other failures of third party services we collaborate in the resolution of such problems. However, in such cases we cannot be deemed liable for any costs. Making a rental down payment and entering into a rental agreement is the clients’ implicit acceptance of these terms and conditions. These terms are notified at various stages during the reservation process - when making a reservation online – when providing a quotation –when a client confirms their reservation by making payment.
Internet services in apartments
Many of the apartments offered on this website also include high-speed internet access. If the apartment includes high speed internet, you will probably find one of the following services: Cable MODEM, ADSL, or WIFI. Third party services and telecommunications are not always reliable in Buenos Aires, BA Stay is not responsible or liable for any third party service failures including internet service, and we are not internet technicians. Thus, should a third party fail to fulfill service for any reason we can only offer to work with the property owner to resolve the problem and we can offer no guarantee of service or rebates on rent or fees. If you are travelling with a MAC, please be aware that you might not be able to access the Internet from your apartment.
Booking more than 3 months in advance, long term rentals, high-end rental properties
When booking more than 3 months in advance, reserving an apartment long term or when booking high end rental properties, some owners ask us to vary our terms and expect clients to demonstrate their commitment to a reservation by paying between 30% and 50% of the total rent in advance. Additionally, in the event of a cancellation, this money is non-returnable. In the event a property owner requires a modification of our terms, we will make these changes clear when you make your reservation and we will also provide notice of the variation by noting the changes of terms in our quotation.
Important: A reservation confirmed by sending the down payment via PayPal, Western Union or bank transfer (made at least 30 days in advance) is non-refundable and making a reservation demonstrates acceptance of these terms and conditions. There is not an option to ‘provisionally’ reserve an apartment and if we hold an apartment for you by agreement, you must first pay at least 20% of the rent as a non-refundable rent down payment.
Clients accept when making a reservation that any costs payable by BA Stay to reimburse property owners, collect rents, collect security deposits, collect any other money or cancellation fees or send money to clients are payable in full by the client. The client accepts to pay all reasonable costs and indemnifies us against our costs should BA Stay be forced to recover a debt both in Buenos Aires or a clients’ country of origin.
